White Collar Crimes – When to Consult a Criminal Attorney

December 27th, 2009

White collar crime cases in Miami, Florida or nearby areas such as West Palm Beach or Fort Lauderdale often call for the services of a professional Miami criminal attorney. Attorneys are needed for a variety of reasons because legal cases – no matter how insignificant they may seem – can become complicated in a hurry. When they do, having a knowledgeable Miami criminal attorney on your side can make all the difference in your trial’s outcome.

What are White Collar Crimes?

These are crimes that are mostly related to financial matters. They include but are not limited to fraud, bribery, computer crimes, embezzlement, pension fund crimes, consumer fraud, bankruptcy fraud, securities fraud, occupational crimes, RICO crimes, identity theft, financial fraud, medical crimes, and forgery. White collar crimes often go undetected because they are usually committed using computers or paperwork; however, these crimes are punishable by law and may result in prison time or restitution if the defendant is found guilty.

Those who commit such crimes are often persons of a high social status. A criminal lawyer that specializes in white collar crimes will usually represent those whose reputation and integrity are at stake in the business or political realms. In Florida, there are Miami criminal lawyers who can represent white collar defendants on a state or federal level.

How can a Miami Criminal Attorney Help?

Whether you’re facing white collar crime charges or the charges have already been brought against you, a Miami criminal attorney can assist with a number of tasks. He/she can help you cope with the situation by offering viable advice and legal solutions. A criminal lawyer can help you build an effective defense strategy, and maybe even resolve the case before it ever goes to trial. A lawyer might be able to find alternatives to serving time in prison if possible with your particular case. Sometimes a plea agreement can be made in which you plead guilty to a lesser charge so the more serious charge will be dropped.

It’s a good idea to consult with a Miami criminal attorney before answering any questions brought forth by investigators. Keep in mind that anything you say can harm the case, even if it seems unimportant at the time.

Use online resources to find a reliable criminal attorney. The search engines will render results based on keywords or phrases you type. For example, if you need a lawyer in West Palm Beach, Florida, you might type in “West Palm Beach criminal lawyer.” To find a lawyer in Fort Lauderdale, type in “Fort Lauderdale criminal lawyer” or “Fort Lauderdale criminal attorney.” In the Miami area, you might type, “need a Miami criminal lawyer” or “hire Miami criminal attorney.” The key is to conduct specific searches based on your needs. You might type these phrases along with a word or two about your particular charges. An example would be “Miami criminal attorney for bribery” or something similar.

Don’t forget that white collar crime trials often lead to civil action lawsuits as well if victims are involved. You’ll want a criminal attorney that’s capable of handling any legal “curve balls” that come your way before, during and after the trial. The right Miami criminal lawyer can guide you to make the right decisions through the entire process.

Who Needs a Criminal Attorney? Often, White Collar Professionals

December 24th, 2009

In a recent interview a Fort Lauderdale criminal lawyer, a West Palm Beach criminal lawyer, and a Miami Criminal lawyer spoke about the types of clients they regularly represent. Many people were surprised to find out that the majority of their clients were not malicious types of criminals but those who have been accused of white collar crimes in business and especially in the stock market. Businessmen and women who are accused of getting caught with their hands in the cookie jars; those were the largest majority of clients these attorneys see.

The Fort Lauderdale attorney stated that the majority of clients that come into his office for representation are bankers and executives who are dealing with being accused of embezzlement and or fraud. These are called white collar crimes and often carry a very high prison sentence. Criminal attorneys in these cases work very hard to get their clients shorter prison terms or even no prison terms. Clients pay the criminal attorney well to represent them and help them get their lives back.

The West Palm Beach criminal attorney stated that the majority of clients he represents are facing accusations of fraud in the real estate business. Again, white collar crime that the criminally accused has not physically hurt anybody but often time’s innocent people who have lost substantial savings by the hands of fraud. The criminal attorneys are hired to represent the accused in hopes of a shorter prison term and smaller financial fines.

The Miami Criminal attorney stated that he represents clients who are accused of crimes concerning stock market dealings. These types of white collar crimes are rather common and tend to substantiate a good portion of his practice. This attorney also stated that he has represented quite a few politicians or members in government who have been accused of a variety of white collar crimes and seek the representation of counsel.

The fact is crimes such as murder, rape, carjacking, and drug related crimes are generally committed by individuals who cannot afford the services of a criminal attorney in private practice. Those cases are usually represented by public attorneys that are assigned the cases by the court. The exception is, however, high profile cases by celebrities who get caught up in criminal behavior and thus need the services of a good criminal lawyer.

Criminal attorneys are often stereotyped in a negative perception. However they have a job to do and as the law of this country states, everybody is entitled to fair legal representation. Somebody has to speak for those accused of these crimes and that is what the criminal attorney is in practice for. They are highly skilled litigators who understand the law very well and know how to present the facts of the law so that a jury can understand it. It is important that a good criminal attorney understands how people think as they can use that understanding to make the facts of a case work better for their clients.

Finding the Best Criminal Attorney For Your Needs

December 15th, 2009

Certainly nobody likes to think about waking up one day and finding themselves in need of a criminal attorney but if it happens it’s good to know that the residents of south Florida have choices. From the Fort Lauderdale attorney, Miami attorney, to West Palm Beach criminal lawyer, the southern areas of Florida have many excellent lawyers to take care of you if and when you ever need their assistance.

Sometimes being an attorney is a thankless job; some people see these lawyers as working for the bad guys. But in our country everybody has the right to a fair trial and that means everybody has the right to legal counsel. That legal counsel should be well educated in the many laws that govern each state and country. A Fort Lauderdale criminal lawyer will need to know entirely different aspects of the law than a business lawyer from Boston. A Miami criminal lawyer will need to be well versed in litigation concerning felonies whereas a mortgage attorney will not need to know such things.

A well-educated attorney can make bad decisions that somebody made be less painful when it comes to trial and sentencing. It is the criminal attorney’s job to support the innocents of the client and to make the job of the prosecutor more difficult. The burden of proof falls on the prosecutor and they must prove the clients guilt while the attorney supports the clients’ innocents. Ultimately the client puts his life in the hands of his criminal attorney and that is why it’s very important to make sure one has the best criminal lawyer you can get.

It is a misconception that criminal attorneys only have clients that are of the most deviant of offenders. This is not true. Certainly those accused of crimes such as murder, robbery, and rape need the assistance of a criminal lawyer but also those accused of white-collar crimes in business need the assistant of a knowledgeable criminal attorney as well. A good percentage of clients who seek the help of a criminal attorney are those who are accused of white-collar crimes such as business executive and those in the stock market.

There are many high profile cases that are spotlighted by the media; many criminal attorneys have made a name for themselves when representing one of these high profile cases. This is when a criminal attorney needs to have all his ducks in a row because all eyes are on him/her to see how he/she will represent the client and if he or she will win. Not all criminal attorneys like or even want a high profile case because they tend to be rather difficult cases. Being in the spotlight doesn’t always work well for the defense.

It is safe to say that should you ever need an attorney you will want to get the very best in the business. If you need a criminal lawyer your life is on the line; a good attorney will help you get back your life.
